These terms set out the rights and obligations of users, subscribers and the provider. They are a translation; the Slovenian text prevails.

1. General provisions and provider details

These general terms govern the use of the website challanger.com and the Challanger application, and the conclusion of subscriptions to Challanger subscription packages.

Provider: Befine-Pro d.o.o., poslovno informacijske storitve d.o.o., Križ 249, 6210 Sežana, Slovenia; registration number 8628050000; VAT ID SI97591971. Contact: [email protected], tel. +386 41 468 699.

The terms form part of every contract concluded through the website or the application. By registering or subscribing, the user confirms that they have read and accept the terms. Before the contract is concluded, the terms are available to the user in a form they can save and print.

Provisions marked in these terms as applying to consumers apply only to natural persons concluding the contract for purposes outside their trade or profession. Legal entities, associations and sole traders are governed by the other provisions and the Code of Obligations.

The terms are available in Slovenian and English; the contract is concluded in one of these two languages. In case of discrepancies between the language versions, the Slovenian prevails. Details of a concluded subscription are available to the subscriber in their user account, and invoices and payment receipts in the payment service provider’s billing portal, linked from the application.

Questions about personal data protection are governed by the Privacy and Cookie Policy published on the website.

3. User account and rules of use

Using the application requires a user account, which a person aged at least 15 may open; younger persons need the consent of a parent or guardian. On registration the user must give true data and keep it up to date.

The user is responsible for protecting their password and for all activity in their account. They must notify the provider immediately of any suspected misuse of the account.

The user may not use the application:

  • contrary to the law or to publish unlawful, offensive, discriminatory or misleading content,
  • to enter other people’s personal data without an appropriate legal basis,
  • to infringe copyright or other rights of third parties,
  • for attempts at unauthorised access, disrupting operation or denial-of-service attacks,
  • for automated data collection (e.g. scraping) without the provider’s written permission.

The provider may remove content that breaches these terms and, in the case of a serious or repeated breach, temporarily or permanently disable the user’s access to the account. It informs the user of the measure and the reason, unless this would endanger an investigation or the safety of other users. The user may object to the decision at the contact e-mail address.

The user may delete their account at any time on their profile in the application or by request to the contact e-mail address. Deleting the account does not cancel the obligation to pay for a subscription period already invoiced.

The provider strives for uninterrupted operation of the application but does not guarantee one hundred per cent availability. Longer planned maintenance is announced in advance on the website where possible.

4. Subscription packages

A subscription is concluded for a period of one month or one year, at the subscriber’s choice, and renews automatically for the same period until the subscriber cancels it. The contract is concluded when the subscriber chooses a package in the application and confirms the order in the order summary with the button “Order with obligation to pay”. The payment service provider then takes the payment, and the subscriber receives a payment receipt by e-mail.

Prices are published in the current price list on the website: challanger.com/pricing. A yearly subscription costs less than twelve monthly ones; the ratio is given in the price list.

All prices include VAT. The subscription is paid in advance for each period.

The price of a club package depends on the number of players in the club. The number is checked on the first day of each month; if it changes the price, the provider informs the subscriber by e-mail before the next renewal, and the new price applies from the next billing period.

Trial package. Every new user account receives a free 30-day trial of the PRO package. When it ends, the account moves to the free package and nothing is charged, unless the subscriber expressly chose a paid package during the trial; that package is charged when the trial ends.

Price changes. The provider informs the subscriber by e-mail of a change in the price or content of a package at least 30 days before it takes effect. Until then the subscriber may cancel the subscription free of charge; otherwise the new price applies from the next billing period.

Cancellation. The subscriber may cancel the subscription at any time in the application (in the billing portal reached through the link for managing payments) or by e-mail to the contact address. Cancellation takes effect at the end of the current paid period; until then the subscriber has access to all functions of the package. The provider may cancel a subscription with 30 days’ notice, or immediately in the case of a serious breach of these terms.

Data after the subscription ends. When a subscription ends, the account moves to the free package. Competitions, results and other data remain stored and available to the extent of the free package until the subscriber deletes them or deletes the account; functions that belong to a paid package (e.g. exports of club records) are no longer available.

5. Court and wellness bookings

Through the application a user may book a court or wellness slot at a venue that publishes its slots in the application. A booking is a contract between the user and the venue. The venue sets prices, opening hours and the cancellation deadline and is responsible for the venue and the service provided; the provider acts only as the provider of the application.

A booking is valid once the venue confirms it, or on submission where the venue confirms bookings automatically. The user sees the status of the booking in the application.

The slot is paid to the venue on its terms (e.g. at the reception in cash or by card, or with a package of visits). The provider does not accept payments for bookings.

The user may cancel a booking in the application up to the deadline set by the venue. On timely cancellation, a visit paid with a package returns to the package. Late cancellation and no-shows are settled with the venue on its terms.

6. Consumer’s right of withdrawal

A consumer may withdraw from a subscription within 14 days of concluding the contract without giving reasons, by sending the provider an unambiguous statement to [email protected] or using the form in the annex.

If the consumer expressly asked for the paid subscription to start during the withdrawal period, they pay a proportionate part of the price for the period up to withdrawal. The provider refunds payments at the latest within 14 days of receiving the statement, using the same means of payment.

The right of withdrawal does not apply to legal entities and sole traders.

7. Non-conformity of services, complaints

For subscriptions to the application, the application must conform to the contract for the duration of the subscription. The consumer reports a non-conformity (e.g. a function of the package does not work) to the contact e-mail address; the provider remedies it within a reasonable time, failing which the consumer may demand a proportionate price reduction or withdraw from the contract.

8. Intellectual property and user content

The application, the website, the Challanger brand, logos, design and program code belong to the provider or its licensors. With a subscription, the user acquires a non-exclusive, non-transferable right to use the application to the extent of the chosen package, for the duration of the subscription.

User content remains the property of the user or the organiser. The user grants the provider a non-exclusive, free right to store, process and display this content to the extent needed for the application to work, including public display of results of competitions the organiser marks as public.

The user warrants that they hold all rights to publish the uploaded content (e.g. photos and videos of matches) and the consent of persons identifiable in it. The user indemnifies the provider against third-party claims arising from a breach of these rights.

The provider may use anonymised and aggregated data about the use of the application to improve its services and for statistical purposes.

9. Processing of personal data on behalf of the organiser

This section is a data processing agreement under Article 28(3) GDPR between the organiser as controller and the provider as processor. It applies to personal data of competitors and other persons the organiser enters into the application.

ElementContent
Subject and purposeproviding the application for organising competitions and running a club: fixtures, results, standings, statistics, news, messages to participants, member register
Durationthe duration of the subscription or use of the application, and the deletion period after it ends
Data subjectscompetitors, captains, reporters, club members and other participants in competitions
Types of datafirst and last name, e-mail address, club, results, placings, statistics, photos and videos, content of messages; in a club’s member register also date of birth and parents’ contact details, and members’ medical notes (a special category of data under Article 9 GDPR), if the organiser enters them

The provider undertakes to:

  • process the data only on the documented instructions of the organiser, which consist of these terms and the settings the organiser chooses in the application;
  • ensure that persons with access to the data are bound by confidentiality;
  • apply the technical and organisational measures of Article 32 GDPR;
  • engage sub-processors only under this general authorisation, with the same obligations as apply to the provider; the categories of sub-processors are listed in the Privacy Policy and the provider sends the organiser the list of individual sub-processors on request; it informs the organiser of intended changes of sub-processors at least 15 days in advance, and the organiser may object to the change and cancel the subscription;
  • assist the organiser in responding to requests from individuals and in meeting the obligations of Articles 32 to 36 GDPR;
  • notify the organiser of a personal data breach without undue delay and at the latest within 48 hours of becoming aware of it;
  • after the subscription ends, return or delete the data at the organiser’s choice, unless the law requires it to be kept;
  • make available to the organiser the information needed to demonstrate compliance and allow reasonable audits on prior notice.

The organiser is responsible for the lawfulness of entering the data, for informing individuals and for obtaining consents where needed, including parental consent for children under 15.

The organiser may enter medical notes only with a basis under Article 9(2) GDPR, as a rule the member’s explicit consent (for a minor, that of a parent or guardian). It should enter only data needed for safe training (e.g. allergies or conditions relevant to first aid). Medical notes are never publicly visible in the application; only persons to whom the organiser grants the right to manage members or trainings can see them.

10. Limitation of liability

The provider is not liable for user content, for the accuracy of results and data entered by organisers or competitors, or for the running of competitions organised by users.

The provider is not liable for damage caused by disruptions it could not prevent or remedy (e.g. network outages or third-party service failures, force majeure), or by the user’s breach of these terms.

In dealings with legal entities and sole traders, the provider’s liability for ordinary negligence is limited to the subscription amount the subscriber paid in the 12 months before the damage occurred, and liability for lost profit and indirect damage is excluded.

These limitations do not apply to damage caused intentionally or through gross negligence, to damage to life and health, or to the rights mandatory law grants consumers.

11. Dispute resolution and final provisions

Complaints. We accept complaints at [email protected] and by post to the provider’s address. We confirm receipt of a complaint within 5 working days, tell you within that period how long we will need to deal with it, and keep the consumer informed of its progress.

Law and jurisdiction. Contracts are governed by the law of the Republic of Slovenia. A consumer does not thereby lose the protection given by the mandatory law of their country of residence. Disputes with consumers fall to the court determined by law. Disputes with legal entities and sole traders fall to the court with subject-matter jurisdiction in Koper.

Changes to the terms. The provider may change the terms because of changes in its services or in the law. It notifies registered users of material changes by e-mail or in the application at least 30 days before they take effect. A subscriber who does not agree with a change may cancel the subscription free of charge before it takes effect.

Partial invalidity. If any provision is invalid, this does not affect the validity of the other provisions.

These terms apply from 23 October 2026.
